Valuation Standards in Family-Law Proceedings
North Carolina family-law proceedings rely on two valuation instruments: the licensed appraisal (USPAP-compliant, performed by a state-credentialed real-estate appraiser) and the Broker Opinion of Value (BOV) prepared by a licensed real estate broker. The licensed appraisal is the instrument of record for contested proceedings and equitable distribution. The BOV is appropriate for negotiation, mediation, and settlement framing, and frequently informs the parties' positions before the appraisal is commissioned.
Peters & Associates provides the BOV when retained jointly by the parties or by counsel. Our analysis includes the comparable transaction set, supporting marketing evidence, condition and renovation observations, and a written value range with the assumptions explicitly stated. We do not perform USPAP appraisals; we coordinate with credentialed appraisers in our network when an appraisal is required.
How We Build the Valuation
The luxury comparable set is thin by definition, and the analysis cannot rely on automated valuation models or generalized neighborhood medians. We build the comparable set property by property — typically eight to twelve recent transactions, weighted for genuine architectural, lot, and condition comparability. Where the property has unique attributes (water frontage, historic provenance, recognized architect), we include adjacency-relevant transactions from outside the immediate neighborhood and document the rationale.
Renovation and condition observations are included with explicit cost-to-cure estimates where appropriate. Where the property would benefit from pre-listing improvements that materially affect value, we surface those with vendor estimates so the parties can decide whether to make them or to discount the listing accordingly. The objective is a defensible value range that survives mediation and, if necessary, supports the parties' positions in court.
Selling Versus Buyout
Two outcomes typically emerge from a divorce involving luxury real estate: a sale to a third party with proceeds divided per the equitable distribution agreement, or a buyout where one party acquires the other's interest and refinances or restructures the encumbrance. Each path has distinct execution requirements. The sale path requires marketing strategy, listing preparation, and timing coordination with the divorce schedule. The buyout path requires a confirmed valuation, a financing path for the acquiring party, and execution of the necessary deed and financing instruments.
We frequently advise on the buyout path even when not engaged for the eventual sale, because the valuation work transfers cleanly and because the acquiring party benefits from neutral comparable analysis. Where one party is acquiring the other's interest, we coordinate with that party's lender on the financing structure (rate-and-term refinance, cash-out refinance, or new acquisition financing depending on the circumstance) before the buyout amount is finalized.
Discretion, NDAs, and the Marketing Decision
Divorce-context listings are managed differently than standard luxury listings. Public-facing marketing — open houses, broker tours, social media, sign in yard — is frequently inappropriate or inadvisable, particularly during the period when the proceedings are unresolved or when the parties' privacy concerns are elevated. We market through the private brief network first, surface the property to qualified buyers with confidentiality agreements where appropriate, and coordinate showings with the household occupancy schedule.
Where a public listing is ultimately appropriate, we time the launch, the photography, and the marketing collateral to the parties' agreed schedule. Listing copy is reviewed for any inadvertent disclosure that would compromise privacy. Showings are managed with appropriate access controls and household coordination.
